Uixxie is operated by Uixxie Limited Co. (“Uixxie,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of the Uixxie application, website, features, content, and related services (collectively, the “Service”).

By creating a Uixxie account or otherwise affirmatively agreeing to these Terms, you agree to be bound by them. You also acknowledge that you have read Uixxie’s Privacy Policy, which explains how Uixxie collects, uses, shares, protects, retains, and deletes personal information.

If you do not agree to these Terms, do not create an account or use the Service.

1. Eligibility

Uixxie is intended for users age 18 and older.

By creating an account, you confirm that you are at least 18 years old and legally able to enter into these Terms.

Uixxie currently uses a minimum-age confirmation rather than requiring your date of birth, birth year, or exact age as part of its age-confirmation process.

You are responsible for providing accurate account information and for maintaining the security of your account credentials.

You may not use another person’s account without permission or impersonate another person.

2. What Uixxie Provides

Uixxie is a health and wellness tracking application designed to help users organize and better understand information related to their PCOS experience.

Depending on the features you choose to use, Uixxie may provide tools related to:

  • menstrual cycles and fertility-related information;
  • symptoms and PCOS-related patterns;
  • medications, supplements, schedules, doses, and check-ins;
  • food, nutrition, hydration, and cravings;
  • weight and body measurements;
  • exercise, movement, workouts, and fitness-related information;
  • lifestyle habits and wellness goals;
  • Body Lens;
  • educational articles and research information;
  • Nyii and other AI-supported features;
  • personalized patterns, summaries, and insights;
  • health and wellness information you choose to import; and
  • reports or summaries generated from information available in Uixxie.

You choose which optional features to use and what health or wellness information to provide.

Features may be added, changed, improved, limited, or removed as Uixxie develops.

3. Uixxie Is Not Medical Care

Uixxie is not a medical device, healthcare provider, medical practice, or emergency service. Uixxie does not diagnose, treat, cure, or prevent any medical condition.

Information provided through Uixxie is intended for educational, organizational, tracking, and wellness-support purposes.

Uixxie is not a substitute for advice, diagnosis, or treatment from a qualified healthcare professional.

Information generated, summarized, or displayed by Uixxie may be incomplete, inaccurate, outdated, or inappropriate for your individual circumstances.

You should consult an appropriately qualified healthcare professional regarding medical symptoms, diagnoses, medications, treatment, fertility concerns, or other healthcare decisions.

Emergencies

Uixxie and Nyii are not emergency services.

If you believe you may be experiencing a medical emergency, seek immediate medical attention or contact the appropriate emergency service in your location. Do not wait for a response from Uixxie or Nyii.

4. Nyii and AI-Supported Features

Uixxie includes AI-supported features, including Nyii, designed to help you understand information you have logged, navigate educational content, recognize patterns, and ask questions about your Uixxie experience.

When you choose to use these features, they may work with questions or messages you submit, relevant information you have logged in Uixxie, conversation history, context needed to respond, and patterns, summaries, or insights generated from your Uixxie information.

AI-generated responses can be incomplete or inaccurate.

Nyii and other AI-supported features should not be relied upon as medical advice, diagnosis, or treatment and should not replace professional medical judgment.

How information is processed in connection with these features is described in Uixxie’s Privacy Policy.

5. Information You Provide

You control what health and wellness information you choose to provide to Uixxie.

You are responsible for reviewing information you enter and, where appropriate, correcting information that is inaccurate.

Some Uixxie features generate patterns, summaries, insights, or other outputs based on information available in your account. Incomplete or inaccurate information may therefore affect those outputs.

Uixxie’s collection, use, sharing, protection, retention, and deletion of personal and health-related information is governed by the Privacy Policy.

Nothing in these Terms changes or reduces the privacy commitments made in that policy.

6. Data Imports

Uixxie may allow you to voluntarily import health or wellness information from supported files or other sources.

When you choose to import information, Uixxie may process the contents of the file or data you provide so that it can identify, preview, and add supported records to your account.

You can review supported records before committing them to your Uixxie account.

Imported information may contain incomplete, inaccurate, duplicated, or differently formatted information depending on its source. You are responsible for reviewing imported information for accuracy.

You represent that you have the right to provide information that you upload or import.

Uixxie handles imported personal and health information as described in the Privacy Policy.

Support for a file format or source does not imply that Uixxie is affiliated with, sponsored by, or endorsed by the creator of that format or source unless Uixxie expressly states otherwise.

7. Educational and Research Content

Uixxie may provide educational articles, Research Spotlight content, summaries or explanations of research, citations, source links, or other educational materials.

Scientific and medical research evolves over time. Research may be preliminary, limited, contradicted or refined by later evidence, or not applicable to every individual.

Research Spotlight and other educational content are intended to help users understand information and research. They are not medical recommendations or guarantees that a particular treatment, intervention, or research finding will be appropriate or effective for you.

When available, Uixxie may provide citations or links to external sources so you can review additional information.

8. Free and Premium Features

Uixxie may provide free features and paid features through Uixxie Premium.

Free users may access features designated as part of Uixxie’s free experience. Certain additional functionality, increased usage, deeper analysis, content, reports, or other benefits may require an active Uixxie Premium subscription.

The features included in Uixxie Premium may evolve as the Service develops.

The price, billing period, renewal terms, and applicable offer information will be displayed before you complete a subscription purchase.

9. Uixxie Premium Subscriptions

Uixxie Premium may be offered as an automatically renewing subscription.

For Android purchases made through Google Play, payment and recurring billing are processed by Google Play and are also subject to applicable Google Play terms and policies.

An automatically renewing subscription will continue to renew at the applicable billing interval unless it is canceled before renewal or otherwise ends.

You can manage or cancel a Google Play subscription using the subscription-management option provided by Uixxie or through your Google Play account.

Deleting the Uixxie app, uninstalling it, or deleting your Uixxie account does not by itself cancel a subscription managed through Google Play.

If you cancel an active subscription, cancellation ordinarily stops future renewal. Unless otherwise provided by Google Play, applicable law, or the terms of a particular offer, Premium access may remain available through the subscription period for which access has already been provided.

Refunds and other billing remedies are handled according to applicable law, applicable Google Play policies, and any additional refund rights expressly offered by Uixxie.

10. Founding Member Pricing

Uixxie may make promotional Founding Member pricing available to qualifying early Premium subscribers.

Uixxie’s intended initial Founding Member offer is $5.99 per month for the first 1,000 qualifying Premium members, subject to eligibility and the offer terms displayed at purchase.

The planned standard monthly subscription price following the Founding Member offer is $7.99 per month, although future pricing may change in accordance with applicable platform requirements and law.

A qualifying Founding Member may continue at the applicable recurring subscription price associated with that continuously active subscription, subject to Google Play’s billing system, applicable law, and the terms displayed for the subscription.

If a Founding Member subscription is canceled and subsequently expires, lapses, is refunded, revoked, or otherwise terminates, Founding Member pricing is not guaranteed to be available for a later subscription.

Eligibility for promotional pricing may depend on Uixxie’s records, subscription status, offer availability, and information verified through the applicable billing platform.

The price and renewal terms presented through Google Play at purchase should be reviewed before completing the transaction.

11. Beta and Pre-Release Features

Uixxie may make some features or versions of the Service available as beta, test, preview, experimental, or pre-release functionality.

Beta functionality may contain bugs, errors, interruptions, incomplete features, or unexpected behavior and may change during testing.

You should not rely on beta functionality for emergencies, medical decisions, or circumstances in which an error or interruption could cause significant harm.

Uixxie may limit beta participation, modify beta functionality, temporarily suspend testing, or discontinue beta features.

12. Acceptable Use

You agree not to misuse Uixxie.

You may not:

  • attempt to gain unauthorized access to another person’s account or information;
  • impersonate another person;
  • intentionally interfere with the operation or security of the Service;
  • introduce malicious software or code;
  • bypass or attempt to bypass access controls, subscription restrictions, security protections, or beta admission controls;
  • systematically scrape or harvest information from the Service except where authorized by Uixxie or permitted by applicable law;
  • intentionally provide fraudulent information in connection with billing, account access, or eligibility;
  • infringe another person’s rights;
  • reverse engineer protected portions of the Service except where such a restriction is prohibited by applicable law; or
  • use Uixxie for unlawful purposes.

Uixxie may investigate suspected misuse and take reasonable steps to protect users, the Service, and its systems.

13. Your Content

You retain your rights in information and content you submit to Uixxie.

You provide Uixxie with the limited permission necessary to process, store, organize, transmit, analyze, and display that information for the purpose of operating and providing features you choose to use, consistent with the Privacy Policy.

You may not submit content or information that you do not have the right to provide.

Personal information and health-related information are handled according to the Privacy Policy, including its retention and deletion provisions.

14. Uixxie Content and Intellectual Property

Uixxie’s software, branding, designs, interfaces, graphics, original educational materials, compilations, and other original content are owned by Uixxie Limited Co. or used with permission, except for user content and third-party materials.

Subject to these Terms, Uixxie grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purposes.

These Terms do not transfer ownership of Uixxie’s intellectual property to you.

Third-party publications, research, trademarks, product names, and other third-party materials remain the property of their respective owners.

15. Third-Party Services and Resources

Uixxie may rely on or interact with third-party service providers or link to third-party resources.

The Privacy Policy describes service providers involved in processing personal information and explains when limited information may be provided to service providers to operate Uixxie.

Uixxie may also provide links to educational resources, research publications, or other websites operated by third parties.

Uixxie does not control third-party websites or services and is not responsible for their independent content, availability, security, terms, or privacy practices.

When you leave Uixxie to use another service, that service’s own terms and privacy policies may apply.

16. Privacy

Uixxie treats health and reproductive-health information as sensitive information.

Uixxie’s Privacy Policy explains what information Uixxie collects, how it is used, when it may be shared with service providers, how it is protected, how long it may be retained, and the choices available to you.

Nothing in these Terms authorizes Uixxie to use personal or health information in a manner inconsistent with the Privacy Policy.

Please review the Privacy Policy before creating an account.

17. Account and Data Deletion

You may permanently delete your Uixxie account using the account-deletion options Uixxie provides.

When account deletion is successfully completed, Uixxie deletes the account and associated Uixxie user data included in the account-deletion process.

Deletion is permanent and cannot be undone.

Some information may be retained when required by applicable law or where necessary for legitimate security, fraud-prevention, dispute-resolution, or legal purposes, as described in the Privacy Policy.

Deleting your Uixxie account does not by itself cancel a subscription managed through Google Play. If you do not want an active Google Play subscription to renew, you must separately cancel that subscription through the applicable subscription-management process.

18. Suspension and Termination

You may stop using Uixxie at any time.

Uixxie may suspend, restrict, or terminate access if we reasonably believe that:

  • you materially violated these Terms;
  • your use creates a material security, legal, or safety risk;
  • you attempted to access another person’s account or information;
  • you intentionally abused or interfered with the Service; or
  • action is reasonably necessary to comply with applicable law.

Where reasonably appropriate, Uixxie may provide notice or an opportunity to address the issue.

Termination of a Uixxie account does not automatically create a right to a refund for a subscription processed through a third-party billing platform.

19. Availability and Changes to Uixxie

Uixxie works to provide a useful and reliable Service, but uninterrupted or error-free operation is not guaranteed.

The Service may occasionally be unavailable because of maintenance, technical failures, third-party outages, testing, security issues, or circumstances outside Uixxie’s reasonable control.

Uixxie may modify, add, discontinue, or replace features as the Service develops.

Changes affecting paid subscriptions will be handled in accordance with applicable law and applicable billing-platform requirements.

20. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Uixxie is provided on an “as is” and “as available” basis.

Uixxie Limited Co. does not warrant that the Service will always be uninterrupted, error-free, completely secure, or completely accurate, or that use of Uixxie will produce a particular medical, health, wellness, nutrition, fitness, fertility, or other outcome.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

21. Limitation of Liability

To the fullest extent permitted by applicable law, Uixxie Limited Co. and its officers, members, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of or inability to use the Service.

To the fullest extent permitted by applicable law, Uixxie Limited Co.’s aggregate liability for claims arising from or relating to the Service will not exceed the greater of:

  1. the amount you paid for Uixxie during the twelve months immediately preceding the event giving rise to the claim; or
  2. $100 USD.

These limitations do not apply where prohibited by applicable law or to liability that legally cannot be limited or excluded.

22. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Uixxie Limited Co. and its officers, members, employees, contractors, and agents from claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use of the Service, your material violation of these Terms, or your infringement of another person’s rights.

This section does not require indemnification where applicable law prohibits it.

23. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute that may lawfully be required to proceed in a particular jurisdiction will be handled accordingly. Otherwise, disputes arising from these Terms or the Service will be subject to the appropriate state or federal courts in Georgia.

Nothing in this section removes consumer protections or rights that cannot lawfully be waived.

24. Changes to These Terms

Uixxie may update these Terms as the Service changes or as legal, regulatory, security, platform, or operational requirements evolve.

When material changes are made, Uixxie may provide notice within the Service, by email, or through another appropriate method.

Where appropriate or required, Uixxie may require you to review and affirmatively accept updated Terms before continuing to use the Service.

The Effective Date at the top identifies when the current Terms became effective.

25. Severability and Entire Agreement

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by applicable law.

These Terms, the Privacy Policy, and any additional terms presented for a particular promotion, subscription offer, or feature constitute the applicable agreement between you and Uixxie regarding your use of the Service.
